The Trump administration has a narrow view of gender, and in the eyes of the law, his Ministry of Health and Human Services will determine sexuality as defined by science – that is, male and female.
HHS has completed a rule under section 1557 of the Affordable Care Act which restored the traditional definitions and revocation of the redefinition of sexual discrimination made under President Obama. The previous administration has defined the gender as “the internal meaning of a sex man.”
As of Friday, it’s no longer available.
“We are restoring respect to the rules of Law,” Roger Severino, director of Office for Civil Rights in HHS (figure above), told RealClearPolitics. The old definition was made by Obama, he argued, has created “extraordinary confusion in the fields of science and health.”

. Controversy will surely follow, especially before the presidential election.
But advancing ahead of the culture war is not the goal. Severino says he wants to clear-eyed adjustments instead, who is guided by science rather than translating political gender. “If there is any organ where the biological understanding of sexual problems, it would be HHS,” he told RCP. “We have done a lot of work in the field of medicine and science where gender is considered a biological variable.”
The administration believes the courts will rule over its face.
